Judge Denies Fani Willis’ Request to Tell Trump’s Co-Defendants Not to Invoke Their Speedy Trial Rights

A Fulton County judge denied District Attorney Fani Willis’ request to tell former President Donald Trump’s co-defendants not to invoke their speedy trial rights.

Trump and 18 co-defendants were indicted last month on 41 RICO charges related to the 2020 election.

All defendants are entitled to a speedy trial. But Willis wants to try all 19 defendants in the same courtroom in October 2023.

Trump has asked that his case be moved to federal court for trial at a later date in 2024.

Two co-defendants, Trump attorneys — Kenneth Chesebro and Sidney Powell, asked for speedy trials scheduled for next month.

But Willis filed a motion asking the judge to inform the co-defendants that invoking their speedy trial rights would not be beneficial to them.

Fulton County Superior Court Judge Scott McAfee denied Willis’ request.

“Many of the deadlines highlighted within those cases, if imposed, would directly conflict with this Court’s Standing Case Management Order and its routinely entered case specific scheduling order,” McAfee wrote in a one page response.

Atlanta area attorneys noted that Willis opposes the defendants’ rights to speedy trial because, if successful, their trials would provide a “preview” for Trump’s defense if his case is moved to federal court.

“She doesn’t want to have to give this whole preview of the case to Trump and everybody else,” said Andrew Fleischman, a Georgia-based appellate attorney.
